1. Agreement to Terms

Welcome to IronForge Fitness ("Company", "we", "our", "us"). These Terms and Conditions ("Terms") govern your access to and use of our website located at your-domain.com (the "Website") and all related services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access our Services.

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Services after such modifications constitutes your acceptance of the updated Terms.

3. Services and Membership

3.1 Fitness Services

IronForge Fitness provides fitness training services, including but not limited to gym facilities, personal training, group classes, nutritional guidance, and online workout programs. All services are subject to availability.

3.2 Membership Plans

Various membership plans are available with different terms, pricing, and benefits. Specific details are outlined in your membership agreement. Membership fees are non-refundable except as required by applicable law.

3.3 Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time without prior notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Services.

4. Health and Safety

4.1 Medical Clearance

You represent and warrant that you are in good physical condition and have no medical condition that would prevent you from participating in fitness activities. You are strongly advised to consult with a physician before beginning any exercise program.

4.2 Assumption of Risk

You acknowledge that participation in fitness activities involves inherent risks, including but not limited to risk of personal injury, disability, or death. You voluntarily assume all risks associated with your use of our Services and facilities.

4.3 Release of Liability

To the maximum extent permitted by law, you release and hold harmless IronForge Fitness, its owners, employees, trainers, and agents from any and all claims, demands, or causes of action arising from your use of our Services or facilities, including those based on negligence.

5. User Obligations and Conduct

5.1 Facility Rules

When using our facilities, you agree to:

• Follow all posted rules and staff instructions
• Use equipment properly and safely
• Maintain personal hygiene standards
• Return equipment to its designated location after use
• Report any equipment malfunction or safety hazards immediately
• Respect other members and staff

5.2 Prohibited Conduct

You agree not to:

• Engage in any illegal, harmful, or offensive behavior
• Harass, threaten, or intimidate other members or staff
• Use the facilities while under the influence of drugs or alcohol
• Bring weapons or dangerous items onto the premises
• Damage, vandalize, or misuse our property or equipment
• Provide false or misleading information
• Share your membership with unauthorized persons
• Record or photograph other members without consent
• Solicit or conduct unauthorized business on our premises

6. Payment Terms

6.1 Fees and Billing

You agree to pay all fees associated with your selected membership plan or services. Fees are charged in advance on a recurring basis according to your billing cycle (monthly, quarterly, or annually).

6.2 Payment Methods

We accept various payment methods as indicated during checkout. You authorize us to charge your selected payment method for all fees incurred.

6.3 Price Changes

We reserve the right to modify our pricing at any time. Price changes will be communicated with at least 30 days' notice and will apply to subsequent billing cycles.

6.4 Late Payments

Late or failed payments may result in suspension of your account and Services. You remain responsible for all unpaid fees plus any collection costs incurred.

6.5 Refund Policy

All fees are non-refundable except as required by applicable law or as expressly stated in your membership agreement. Refunds, if applicable, will be processed within 14 business days.

7. Intellectual Property Rights

7.1 Our Content

All content on our Website and Services, including text, graphics, logos, images, videos, software, and compilation thereof (the "Content"), is the property of IronForge Fitness or its licensors and is protected by Croatian and international copyright, trademark, and other intellectual property laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for personal, non-commercial purposes. This license does not include any right to:

• Modify, reproduce, distribute, or create derivative works
• Reverse engineer or decompile any software or technology
• Remove any copyright or proprietary notices
• Use our Content for commercial purposes without written consent

7.3 Trademarks

IronForge Fitness and all related logos, product and service names are trademarks of IronForge Fitness. You may not use these trademarks without our prior written permission.

7.4 User Content

If you submit any content to our Services (including reviews, testimonials, or photos), you grant us a worldwide, royalty-free, perpetual license to use, reproduce, modify, and display such content for business purposes.

8. Privacy and Data Protection

Your use of our Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We collect, use, and protect your personal data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR) and Croatian data protection legislation.

9. Disclaimers and Warranties

9.1 Service Availability

Individual results may vary. We make no guarantees regarding specific fitness outcomes, weight loss, muscle gain, or other health improvements. Success depends on individual effort, consistency, genetics, and other factors beyond our control.

10. Limitation of Liability

10.1 Exclusion of Damages

To the maximum extent permitted by Croatian law, IronForge Fitness, its directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our Services, including but not limited to:

• Personal injury, disability, or death
• Loss of profits, revenue, or data
• Business interruption
• Loss of goodwill or reputation
• Equipment damage or loss of personal property

10.2 Liability Cap

Our total liability for any claims arising from these Terms or your use of our Services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

10.3 Exceptions

Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our gross negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.

11. Indemnification

You agree to indemnify, defend, and hold harmless IronForge Fitness and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of our Services
• Your violation of these Terms
• Your violation of any rights of third parties
• Your violation of applicable laws or regulations
• Any content you submit or transmit through our Services

12. Termination

12.1 Termination by You

You may terminate your account at any time by contacting us or using the account cancellation feature. Cancellation requests must be submitted at least 30 days before your next billing date. You remain responsible for all charges incurred prior to termination.

12.2 Termination by Us

We may suspend or terminate your account and access to our Services immediately, without prior notice, for:

• Violation of these Terms
• Non-payment of fees
• Fraudulent or illegal activity
• Conduct that damages our reputation or business
• Any other reason at our sole discretion

12.3 Effect of Termination

Upon termination, your right to use our Services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including intellectual property rights, disclaimers, indemnification, and limitation of liability.

13. Governing Law and Jurisdiction

13.1 Applicable Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Croatia, without regard to its conflict of law principles.

13.2 Jurisdiction

Any disputes arising from these Terms or your use of our Services shall be subject to the exclusive jurisdiction of the courts of Croatia. You consent to the personal jurisdiction of such courts and waive any objection to venue.

13.3 EU Users

If you are a consumer residing in the European Union, you may also have the right to bring proceedings in your country of residence.

14. Dispute Resolution

14.1 Informal Resolution

Before filing any formal claim, you agree to contact us and attempt to resolve the dispute informally. Please send a detailed description of the dispute to our contact email, and we will work with you in good faith to reach a resolution.

14.2 Mediation

If informal resolution is unsuccessful, both parties agree to attempt mediation before pursuing litigation. Mediation shall be conducted by a mutually agreed-upon mediator in accordance with Croatian mediation procedures.

14.3 Arbitration

If mediation fails, disputes may be submitted to binding arbitration in accordance with the rules of the Croatian Chamber of Economy. The arbitration shall be conducted in English or Croatian, at the location specified by the arbitrator.

14.4 Class Action Waiver

You agree that any proceedings to resolve disputes will be conducted on an individual basis and not as a class, consolidated, or representative action.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us, constitute the entire agreement between you and IronForge Fitness regarding your use of our Services.

15.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. Any waiver must be in writing and signed by our authorized representative.

15.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign or transfer these Terms at any time without restriction.

15.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, riots, natural disasters, pandemic, government action, or failure of third-party services.

15.6 Language

These Terms may be translated into other languages for convenience. In the event of any conflict between the English version and any translation, the English version shall prevail.
